Q: What is a visa?
A: A visa is a document (stamp) placed in a passport by a United States Consul.
The consul is always outside the United States.

Q: What is the difference?
A: Nonimmigrant visas are for people who don't want to live in the U.S. permanently,
although, depending on the type of visa issued, the period of admittance can be for
many years. Therefore, immigrant visas are for people who come to live permanently.
People with immigrant visas are still considered citizens of their home country.

Q: How do I obtain a nonimmigrant visa?
A: There are different procedures for various categories. In general, for B, C, D, F, I,
J, M, Q, and R visas, go directly to U.S. consul, with evidence needed, and apply on
form OF 156. For H, K, O, P must first have a petition approve in the U. S. by the
INS (Immigration and Naturalization Service).

Q: Is the U.S. consul obligated to give me a visa, even if I already have a valid petition
approved (if one is necessary)?
A: No. U.S. immigration law says that everyone coming to U.S. is considered to be an
immigrant unless they can prove they have the intention to leave country when the
purpose of their trip is completed. Some must prove they have an unabandoned home
that they will return to, others don't have quite so high a burden.

Q: Does the issuance of a visa guarantee entry into the U. S., if it is still valid?
A: No. the United States has a dual check system. First check is the consul, however,
once visa holder presents the visa to the INS asking for admittance, INS has a second
review. Visa holder must convince INS inspector at port of entry that he/she is
qualified for visa category and intends to comply with its intent.

Q: How long may nonimmigrant visa holder stay in the United States?
A: INS controls how long the admittance is for. If a preliminary petition is need for
visa issuance, the length of the petition controls, which may not be exceeded ( but
may be extended sometimes). If no petition is needed, INS some categories provide
entry for up to one year, and others up to six months, or some for duration of status.
However, inspector at port of entry issues actual length.

Q: How do I know how long I am able to stay?
A: INS inspector at port of entry will issue form I-94 if visa holder is admitted. This
looks like a small white card and is generally attached to passport (so won't get lost).
Status of admittance and length of time admitted is stamped on it. It is this, and this
alone which tells alien how long he/she may stay.

Q: If the length of time in visa expires, and I am already in United States, may I still
remain?
A: Yes. Remember it is the length of time on the I-94 that controls length of stay, not
the visa. The visa only lets alien come to the U.S. It is INS who controls how long the
alien may stay in U.S.
