Working With Foreign Nationals: Section 4

Foreign National Visitors


Release* of technology to a visiting Foreign National may be subject to export control laws.

Visiting foreign nationals* should be screened against debarred parties lists to ensure compliance with regulations. (Request a free screening: contact UC's Export Control Team).

Before working with visiting foreign nationals*, be sure your collaboration qualifies as fundamental research*. In many instances, a visiting scientist agreement may need to be signed. (Contact UC's Export Control Team)

Before a foreign national is allowed to visit or tour controlled facilities (that contain EAR or ITAR controlled equipment for example), or engage in any activity that would be considered an export (including deemed), a form will need to be filed with the government for approval. The form itself will need to be filed by UC's Export Control Team. The Guidelines for Preparing Export License Applications Involving Foreign Nationals pdf file will give you an idea of the type of information needed to fill out those forms (the pdf is specific to the EAR form, but the content is similar to the ITAR form also)

An export* is defined as the release of controlled technology* to a foreign national*.

Release* is defined as:


  • Visual inspection by foreign nationals*
  • Oral exchanges of information in the United States* or abroad
  • The application to situations abroad of personal knowledge* or technical experience acquired in the United States*
