Resident Alien with a Tax Treaty Benefit


Your Tax Status is If you
Category IV
Resident Alien with a Tax Treaty Benefit
  • Have been in the US as an F-1, or J-1 Student in more than 5 calendar years (you arrived at anytime in the year 2007, or earlier).
  • Have been in the US as a J-1 non-student in more than 2 calendar years (you arrived at anytime in the year 2010, or earlier).
  • Have been in H-1B status for 183 days or more during 2012.
  • Obtained Permanent Residency status (Green Card) at anytime in 2012 or earlier.
  • Obtained US Citizenship at anytime in 2012 or earlier.

If you are from one of the countries listed here then you also may be able to claim a tax treaty benefit.There is no software product available to assist with these kinds of returns.

If you are a Resident Alien and eligible to claim a tax treaty benefit for 2012 you will need to contact James.Tenney@uc.edu with the subject line “RA with a Tax Treaty Benefit”. You should include your name and UC ID number. He will verify your eligibility and send some instructions on how to input the data. After inputting the information on a tax return you can then go to the College of Law for assistance in finishing your return. The College of Law will not assist with tax treaty questions or inputting of data concerning tax treaties. You must use the instructions and input the tax treaty income on your tax return before going to the College of Law.
