Welcome and Administrative Matters

Judge John West, Chairman, and Dr. Robin S. Engel

  • Judge West began the CCC meeting by calling the room to order.
  • Name changed from CAC to CCC- Community Compliance Council
  • Dr. Abercrumbie was announced in his new role as Special Assistant to the President.
  • Dr. Engel announced all 276 Exiger recommendations were all sent by 12/31/2018.
  • Outstanding accreditation for IACLEA still stands.
  • Dates discussed for Exiger return for presentation to BoT Audit & Risk Management Committee and CCC.
  • Judge West discussed new rule to ensure Policy and Procedures are followed on all internal investigations and all Use of Force cases.
  • Judge West indicated the new rule will not be to second guess the investigation but to ensure the investigations are compliant with Use of Force policies and citizen complaints policies.
  • Judge West will meet monthly with Director Whalen and Chief Herold and then meet with the President of the University to ensure compliance.
  • Dr. Engel’s role will be assigned as a committee member.
  • Dr. Abercrumbie requested representation for a committee member from Student Affairs, once he departs on April 30th.
  • Dr. Abercrumbie suggested Daniel Cummins

Community Compliance Council (CCC)

  • See Slide 3 in the PowerPoint for the CCC structure.
  • Director Whalen provided copies of disciplinary matrix, citizen complaint policy and Use of Force police to all committee members.
  • Director Whalen reviewed major points of the policies with committee members
  • CCC involvement, Chief will provide quarterly update of complaint processes, procedures and dispositions. 

Complaints Process Overview

  • UCPD reported complaints Jan 1-Dec 31, 2018 there were 25 separate cases with 34 allegations.
  • Slide 8 of the PowerPoint shows the count of allegation types
  • Slide 9 of the PowerPoint shows the count of allegations by employee role
  • Slide 10 of the PowerPoint shows the allegations by disposition
  • Dr. Engel advised this is general information from 2018 but the quarterly reports will be detailed reports.
  • Committee members requested examples of discourteous allegations, definition of discourteous discussed with members.
  • Chief Herold agreed to provide a brief summary of all citizen complaints to committee members.
  • Officer Newlin agreed with other committee members to have brief description of citizen complaint reviewed with committee members.
  • Sinna requested getting the facts due to student’s involvement to relay back to her peers, not detailed but short condensed version.
  • Judge West suggested we come up with a template to give the committee all the info they need by the March meeting. 

Use of Force Investigation Process Overview

  • Use of Force policy and section critical decision making model discussed with committee members.
  • The Use of Force Review Board (UFRB) was explained.
  • Contact Cards are completed by Officers when they conduct non-consensual stops
  • The Contact Cards ask if the officer used ICAT skills to de-escalate the situation, this is a constant reminder to use those skills.
  • Psychiatric services request for assistance were discussed regarding Use of Force complaints.
  • Chief Herold discussed when patterns are recognized retraining and policy changes may need to occur.
  • Dr. Engel asked committee members if anything needed to be added to current policies.
  • Lengthy discussion of how Judge West and committee members will be notified if another incident of Sam Dubose nature occurred.
  • Director Whalen indicated that he would call Judge West within 12-24 hours and give as much information as the investigation would allow.
  • Director Whalen would also contact the President of UC.
  • Director Whalen said in most cases the Judge would be contacted within an hour or two with some type of brief report with details on the critical incident.
  • UCPD had 3 cases of Use of Force
  • Slide 16 lists the cases
  • Chief Herold personally watched all BWC videos
  • Judge West asked what body weight was, Chief Herold responded with when a suspect tenses up and the officer grabs or bear hugs them to control them
  • Committee was asked what should be added to make a template
  • Peg suggested the outcome, describing the subject is important

Hiring Update

  • The hiring video was useful
  • Committee received verbal bios of all the new hires
  • 6 were hired as ULEO Apprentice and will complete 6 months with the CPD Academy
  • 3 were hired as ULEO
  • Next opening is for a Security Officer from Ghana
  • Dr. Abercrumbie advised several programs coming up in the next 3 months and suggested that UCPD attend. MLK Program, KUAMKA- See the energy and Step Show
  • Judge West asked if Student Affairs can send out a calendar or newsletter
  • Dr. Engel is very proud of this big recruitment effort
  • Jack asked if the Explorer Program was still ongoing
  • Chief Herold advised it was very challenging, students found it difficult to return to school and report that they were with CPD or UCPD
  • Dr. Engel advised this was done through a Grant and it’s difficult to continue or get outside money
  • Chief Herold would like to write about this, Director Whalen suggested getting M. B. Reilly to write something up
  • Dr. Abercrumbie suggested UCPD going on the Lincoln Ware TV or Radio show
  • Chief Herold agreed if Dr. Abercrumbie could set it up
  • Officer Newlin advised that the Police Union voted and accepted an agreement to a pay raise of 13% over 3 years, will help with recruiting

Judge West advised the next meeting would be March 7, 2019 at 5 p.m.
