Athletics

There shall be a University of Cincinnati athletic committee which shall report to the president of the university. The purpose of the athletic committee shall be to review policies and to provide the president of the university with advice and recommendations about intercollegiate and intramural athletics. The athletic committee shall be established in accordance with applicable rules and regulations of the "National Collegiate Athletic Association", "Association for Intercollegiate Athletics for Women" and any other associations with which the university agrees to affiliate. The athletic committee shall adopt bylaws which shall be subject to approval by the president of the university.

Parking

(A) All changes and additions to the parking rates, fine schedule and changes in violations shall be submitted by the vice president responsible for parking services to the university budget committee with final approval/disapproval by the president of the university.

(B) There shall be an appeals process for violations.

(C) Changes in rules, regulations, and accompanying policies shall be announced in advance of the effective date.

(D) Rules, regulations, and accompanying policies will be available on the parking services website.

(E) The vice president responsible for parking services will implement policy statements and other matters related to the administration of parking in accordance with this rule and applicable laws, and in consultation with the office of general counsel.

(A) The use of a motor vehicle on university property is a privilege, not a right, and is made available only under the university rules, regulations and accompanying policies as set forth in of the Administrative Code 3361:70- 05-01.

(B) Responsibility for the administration of these rules, regulations and accompanying policies as they apply to the parking of motor vehicles rests with parking services. The university police division of public safety assists parking services in the enforcement of regulations and has primary responsibility for the enforcement of regulations applying to moving traffic.

(C) No individual or department, other than parking services, may grant parking privileges for their respective areas, except as may be specifically delegated in writing by parking services. All parking permits are regulated by the university and the university reserves the right: 

  1. To refuse issuance of a parking permit. 
  2. To change parking assignments as deemed necessary.
  3. To restrict the use of any parking space, structure, or surface lot at any time.
  4. To determine hours of control.
  5. To determine mode of operation of any area at any time.
  6. To revoke or recall a parking permit.

(D) The university rules and regulations supersede all previous rules of the university with respect to the control of vehicular traffic and parking on university property and are subject to change. A complete, up-to-date edition of these regulations may be found on the University of Cincinnati’s website.

(E) Changes or modifications of university vehicle regulations and accompanying policies will be on parking services website. Motor vehicle operators are responsible for being aware of changes to university vehicle rules, regulations, and accompanying policies and abiding by them. Rule, regulation, and accompanying policy changes will be announced prior to the effective date.

(A) University liability. No liability is created by the granting of parking or vehicle operating privileges on property owned, leased, or otherwise controlled by the University of Cincinnati. The university assumes no responsibility for the care and/or protection, custody, or control of vehicles or their contents while operated or parked on university property.

(B) Driver responsibility.

  1. The responsibility of finding an authorized parking space rests with the vehicle operator. Lack of a parking space, mechanical problems, inclement weather conditions, attendant not on duty, and other circumstances are not considered valid excuses for failure to comply.
  2. A parking permit does not guarantee the holder a parking space but only an opportunity to park within a specified zone(s).
  3. The failure of the university to insist upon strict compliance with any rule, regulation, or accompanying policy in any one or more instances shall not be construed as a waiver for the future enforcement of any such rule, regulation, or accompanying policy. All rules, regulations, and accompanying policies remain in full force and effect twenty-four hours a day, seven days a week including holidays.
  4. A person who operates a vehicle on the university property while under the influence of alcohol, narcotic drugs, other substances, or opiates will be subject to arrest. 
  5. If an owner permits another person to operate the owner’s vehicle, either the owner or the borrower can be held responsible for any violation of the rules, regulations, and accompanying policies committed by the borrower. 
  6. No parking privileges will be granted to any individual having parking fines and/or outstanding obligations which are unpaid or have not been otherwise cleared. If a permit is issued to an individual having outstanding obligations, it does not eliminate any of the responsibility of those obligations. Parking privileges issued under these circumstances can be revoked.

(C) Speed limit. The speed limit on campus is fifteen miles per hour. It will be strictly enforced by the university police.

(D) Motor vehicles, bicycles, skateboards, and other modes of transportation. 

  1. Operators of motor vehicles, bicycles, skateboards, and other modes of transportation must obey all traffic regulations. 
  2. Licensed motorcycles, motor scooters, and mopeds must have a valid decal to park in designated motorcycle areas. Motor scooters, motorcycles, and mopeds are prohibited from parking on sidewalks. 
  3. Bicycles must be parked in the bicycle racks. Bicycles shall not be parked or stored in any university building, unless otherwise designated. Bicycles shall not be attached to items not specifically intended for bicycle parking, such as trees, signposts, stair rails, or handrails. The university assumes no responsibility for the care and protection of any bicycle at any time or location while on campus.

(E) University and other government vehicles. 

  1. Government licensed vehicles (federal, state, county, or city) are exempt from fee requirements for temporary parking privileges in non-access controlled areas. Long-term parking in designated parking facilities will require a permit with the associated fees. Government vehicles are subject to compliance with all other rules and regulations. 
  2. Operators of university owned or leased vehicles must comply with vehicle rules, regulations, and accompanying policies. If operator's identity cannot be determined, the department to which the vehicle is assigned will be liable for payment of fine(s).

(F) Vehicle accidents. Vehicular accidents occurring on university property must be immediately reported to the university police.

(G) Stall designation.

  1. Parking is permitted only in marked stalls.
  2. Small car: certain stalls are smaller and are designated for compact cars. No part of a vehicle may extend over or beyond painted lines. 
  3. ADA accessible parking: signage designates reserved and nonreserved handicap parking. A valid state-issued disability placard or license plate is required.
  4. Fire lanes: yellow curbs, lines, or signage designates a fire lane. Fire lanes are tow-away zones and must be kept clear at all times.

(H) Reserved parking. Reserved spaces will be allocated at the discretion of the president of the university or designee.

(A) A permit or paid hourly parking is required for all motor vehicles on university property, unless otherwise specified.

(B) Permits must be purchased through parking services. Permits are generally sold on a first come, first serve basis and parking services reserves the right to limit sales in order to prevent oversell.

(C) Permit holders are responsible for providing parking services the most upto-date vehicle information. Permit holders are responsible for citations issued due to their failure to maintain accurate vehicle information with parking services.

(D) Only one permit is issued per person, unless otherwise specified. Permits are not transferable to another person. Multiple vehicles may be assigned to a permit; however, only one vehicle is allowed to park in the facility per permit.

(E) Lost or stolen permits must be reported immediately to parking services. A fee will be assessed for replacement of lost permits.

(F) Physical permits must be returned to parking services, under the following conditions: 

  1. Termination of association with the university.
  2. Change in permit type. 
  3. Cancellation of parking arrangements. 
  4. Issuance of a new permit.

(G) Individuals must follow procedures established by parking services to cancel their parking permit in order to avoid fee obligations. Refunds will be issued pursuant to procedures established by parking services.

(H) Any permit issued by the University of Cincinnati parking services is valid in specified facilities on each campus. Each driver is responsible for learning and observing the rules where the driver is parking. Permit holders must park in the specified facility only.

(I) No parking permit will be issued to individuals having outstanding parking fines or obligations, regardless of the age of the infraction. The issuance of parking privileges to an individual having outstanding obligations does not eliminate the responsibility to pay the outstanding obligations. Permits issued under these circumstances can be revoked.

(J) A person who purchases or uses a university permit in violation of university parking rules, regulations, or accompanying policies may have the permit revoked. Fraudulent applications include but are not restricted to: 

  1. Using a permit in a manner not specified for its use. 
  2. Possessing multiple permits, without authorization, for the same period.
  3. Obtaining a permit to be used by an individual not authorized for such privileges. Persons with a revoked permit will be responsible for returning any physical permit to parking services immediately upon notification. There will be no refund on permits revoked due to fraudulent application. Individuals cited for use of a revoked, lost, or stolen permit will be assessed full charges for use from the date the report was filed with parking services.

(K) Active University of Cincinnati staff, faculty, and designated affiliates are eligible for placement on a waiting list pursuant to parking services procedures.

(A) Permits are honored twenty-four hours a day, seven days a week in the designated area(s), unless otherwise specified.

(B) Faculty and staff may opt for monthly payroll deduction if their appointment is full-time or fifty-percent part-time or greater. Permits on payroll deduction will automatically renew each month, unless cancelled by the faculty or staff member.

(C) Students are eligible to purchase permits by semester, unless otherwise specified.

(D) ADA accessible parking is available in all parking facilities. Students, faculty, and staff with a state-issued disability placard or license plate can purchase a “zone A” parking permit on a first-come, first-serve basis. “Zone A” parking is located in marked stalls along campus drives and at Victory parkway.

(A) Visitor parking.

  1. Visitors must use designated visitor parking facilities. Visitor parking is prohibited on campus drives except as posted or when approved pursuant to the procedures established by parking services.
  2. Visitors are subject to all parking rules, regulations, and accompanying policies and violators will be cited or towed.

(B) Loading and unloading.

  1. Parking passes for loading and unloading for up to thirty minutes will be granted pursuant to the procedures established by parking services.
  2. When loading dock access is needed, a specific request for use must be made pursuant to the procedures established by parking services. 
  3. Established garage rates will be charged for loading and unloading in garages on the east and west campuses.
  4. Parking will not be reserved for deliveries, unless approved by parking services pursuant to its established procedures. Delivery drivers are responsible for any parking violations they incur.

(C) Contractors. Contractors working out of their vehicle must park within a construction area if one has been designated or in an available facility at the daily or monthly rate. Parking charges are to be paid by the contractor.

(D) Parking variances. All requests for parking variances must be submitted pursuant to the procedures established by parking services.

(A) Parking services supervisory personnel or the University of Cincinnati police are the only agencies authorized to commence, in accordance with university rules, the vehicle impoundment or towing process for vehicles parked on university property that are violating university parking rules, regulations, or accompanying policies.

(B) Except as otherwise provided in this rule, towing and/or impoundment of a vehicle may occur when a vehicle is: 

  1. Blocking a fire lane or hydrant. 
  2. Blocking a roadway, drive, dumpster, or loading dock. 
  3. Blocking other vehicles. 
  4. Blocking a pathway needed to facilitate university operations.
  5. Creating a real or potential safety hazard.
  6. Owned or operated by an individual with outstanding delinquent parking citations.
  7. Using a revoked, altered, or stolen permit.
  8. Parked in violation of posted signs and/or barricades.
  9. Parked in a non-reserved ADA accessible stall without state-issued disability placard or license plate. 
  10. Parked in reserved stall without proper permit or permission. 
  11. Parked in an area reserved for event management.

(C) A vehicle that has exited a parking facility by tailgating or by disabling the gate arm, may have a boot placed on the vehicle by parking services upon returning to park on university property. All fines and fees must be paid by the end of the following business day in which the vehicle is booted. If all outstanding fines and fees are not paid by the end of the following business day, the vehicle may be impounded.

(D) Total payment of all outstanding fines, delinquent fees, impoundment fees, and towing charges must be made in order to release the vehicle. If a tow truck is called to move a vehicle and the driver appears before the vehicle is 3361:70-5-08 2 towed and pays all outstanding obligations, the vehicle will not be towed, but the individual is responsible for the tow charge.

(E) Any vehicle remaining on university property for more than seventy-two hours without a valid university parking permit will be considered abandoned. Abandoned vehicles may be towed and/or impounded at the owner's expense. Unclaimed, abandoned vehicles may be sold at public auction, or otherwise disposed, pursuant to Ohio law.

(F) If reasonable, vehicles with a state-issued disability placard or license plate that are improperly parked will be ticketed and the owner/operator will be required to resolve the ticket with parking services. After three unresolved tickets, parking services will place a boot on the vehicle and the owner/operator must resolve the unpaid tickets prior to removal of the boot. In the event that a vehicle with a state-issued disability placard or license plate is towed, the vehicle will be moved to the closest available location and public safety will be notified. Efforts will be made to contact the owner/operator prior to towing the vehicle. If the owner/operator cannot be located, a note will be left where the vehicle was originally parked so the owner/operator will be aware of the situation and has a contact number for expeditious resolution.

(G) All rules regarding impoundment and/or towing are subject to the approval or disapproval of the board of trustees and may not be implemented via policy statements pursuant to university rule 3361:70-5-01 of the Administrative Code. Changes to this rule shall be announced in advance of the effective date.

(H) Individuals may appeal an impoundment or towing citation pursuant to university rule 3361:70-5-10.

(I) The university assumes no responsibility for damages to impounded vehicles, or their contents. Individuals are not permitted to tamper with boots and will be responsible for any damages they cause to a boot placed on a vehicle.

(A) Citation fines will double if not paid or appealed within ten calendar days as indicated on the citation.

(B) A citation may be appealed in accordance with the procedures established by parking services. All appeals are reviewed by the parking appeals committee.

(C) Citations timely appealed do not require upfront payment of the fines. Citations appealed after ten calendar days from the date the citation is issued, require the payment of all fines, and any associated fees, before the appeal can be processed. An administrative service fee will be assessed to all appealed citations that are sustained by the parking appeals committee. If a citation is overturned, all fines and fees paid toward that citation will be refunded.

(D) Simple errors or omissions on a citation, which have no direct effect on the actual circumstances surrounding the violation, are not considered grounds for cancellation of the citation.

(E) All decisions rendered by the parking appeals committee are final.

Residence Halls

(A) Eligibility. Unless otherwise excused, all freshman full-time, unmarried, undergraduate students on the uptown campus, who do not live with their parents or guardians, are required to live in university residence halls as long as space is available. Co-op students who have signed housing agreements are required to live in the residence halls during academic semesters; they are not required to do so during work semesters. Any requests for exceptions to the above policies should be made through the office of housing and food services.

(B) Agreement and lease. Students may make reservations in university residence halls only after all admission requirements have been met. Students shall sign residence and dining hall agreements or apartment leases which must be returned with a security and damage deposit within the designated time period in order to reserve a space or apartment in a university residence hall or apartment facility. The terms and conditions of the residence hall agreement or the apartment lease govern residence in the university's residence halls and apartments.

(C) All full-time students and full-time university employees may live in facilities governed by an apartment lease. The president may establish such other policies as may be necessary to regulate eligibility for rentals in apartment facilities.

(D) The president shall promulgate reasonable and necessary regulations to govern such matters as residence hall security and damage deposits, refunds, conduct and behavior, and care of facilities. The president shall have authority to enter into contracts and leases with students and employees of the university for student space and apartment rentals in the residence halls.

(E) The president may delegate the authority conferred in paragraph (C) and paragraph (D) of this rule.
