What is Title II?

Title II is the section of the ADA that applies to public entities, including public colleges and universities.

The federal government finalized new Title II regulations requiring colleges and universities, to ensure that their web content and mobile applications are readily accessible to and usable by individuals with disabilities by conforming with the requirements specified in Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, the same institutional standard for accessibility that we have been using for many years.

The university is responsible for ensuring that all web content and mobile applications that it provides or makes available, directly or through contractual, licensing, or other arrangements, meets this standard.

This technical standard is now the baseline requirement for websites and mobile applications that we create or make available, including all course content and third–party tools that we choose, with very limited exceptions.

What content does Title II cover? 

The regulations apply to all digital content and services offered by public higher education institutions, directly or through contractual, licensing, or other arrangements.

This includes but is not limited to the following:

  • Course content, including all content in Canvas and instructional materials like textbooks and lecture recordings
  • Digital documents and publications
  • Media: images, videos, audio recordings, podcasts, live streamed content
  • Web content, including public pages and Bearcats Landing
  • Mobile apps
  • Third-party content, software, tools, platforms, and systems
  • Social media
